<p><strong>Exploring the New Frontier: Agency Action in a World without Chevron<br></strong>This presentation will explore the legal landscape associated with agency action after the Supreme Court’s decision overturning Chevron. It will review the Court’s decision, the current standard for challenging agency action, cases relying or expounding on Loper Bright Enterprises, and the regulatory environment now that agencies do not enjoy Chevron deference. The majority of the presentation, however, will be spent covering the practical side of the Court’s decision and how it will affect institutions and their dealings with the Department of Education. We will discuss expectations for litigation going forward, including how challenges will be presented and how courts may respond to challenges to the Department’s regulations. <p><strong>AI: Friend or Foe &#8211; Convincing Faculty It’s Worth the Risk<br></strong>The majority of faculty viewed AI as a foe whose greatest superpower was providing students with a new way to cheat. The PMI Education Department team set out to convince the faculty of its power for good. Arming them with a little bit of background information, the faculty spent the remainder of the time discovering the many ways that they and their students could benefit by befriending AI. This presentation will share the multiple exercises that faculty were guided through, and the impact the work session had on changing their minds regarding the value of AI both in the classroom and as part of preparing them for its use in their new career.<br><strong>Presenters</strong>: Jean Vanderzee, Jeanette Jones and Dr. Jordan Utley with Pima Medical Institute</p>

<p>The Urban Institute is in the final stages of completion of the first of two reports which have been funded in whole or in part by a gift from CSPEN. The first of the two reports examines how earnings change in the later years after students complete their credentials, with a major focus and analysis on earnings changes for fields where a high share of programs have low initial earnings and are likely to fail earnings-based accountability policies like the gainful employment rule. The Urban Institute will highlight the findings of this report for one of the first times at our Conference and will also share an overview of the second report which will focus on the impact of these regulations on specific student demographics from both the macro (Financial Value Transparency) and micro (Gainful Employment) perspective.<br><strong>Presenter</strong>: Jason Delisle, The Urban Institute</p>

In higher education, we need to think about accreditation and compliance in every decision that is made. Building accreditation and compliance into decision processes and having everyone on the same page can create a more relaxed atmosphere surrounding these often-tense topics. <p><strong>The Trifecta of Supreme Court Decisions That Could Hobble the Department of Education<br></strong>The media has trumpeted the Supreme Court’s reversal of the Chevron Doctrine, the legal principle requiring courts to defer to an agency interpretation of a statute when the meaning behind it is not clear. For decades this doctrine has made challenging US Department of Education regulations, including the gainful employment regulations, monumentally difficult. In Loper v. Raimondo the Supreme Court has reversed the paradigm. Lesser known are two other Supreme Court decisions that further and fundamentally weaken the Department’s regulatory power. Corner Post v. Board of Governors has effectively extended the statute of limitations indefinitely to legally dispute even decades-old regulations. SEC v. Jarkesy, brings into doubt the ability of ED to bring fine actions against schools without a jury trial. <p><strong>Turn Around &#8211; Institutional Success<br></strong>There was a time many years ago when institutions/colleges simply had to generate enough inquiries, convert them and magically their schools grew. Today, this is not the case. Several factors are contributing to the decline in student enrollment for many schools. First, the proportion of high school graduates enrolling in college in the fall after they finish high school has dropped from a high of 70 percent in 2016 to 63 percent in 2020. That number has now dropped below 55% (2023). Second, there is less demand (fewer high school graduates) in the market. Since 2010 there has been a consistent decline of degree seeking individuals. Third, the education market has never been so competitive, especially in the online space. Fourth, operating costs have continued to soar (up 22% over past 5 years) just to maintain the same resources for delivery of their curriculum. Finally, small schools especially (non-profit and for profit) have continued to struggle to keep their doors open. In today&#8217;s<br>competitive climate of higher education, institutions/colleges must find ways to differentiate themselves in the marketplace. <h2 class="wp-block-heading">With Support From CSPEN, The Urban Institute Will Unveil Key Financial Value Transparency &amp; Gainful Employment Research During Conference Keynote Presentation</h2>



<p><strong>Overview</strong><br>The Urban Institute is in the final stages of completion of the first of two reports which have been funded in whole or in part by a gift from CSPEN. The first of the two reports examines how earnings change in the later years (5 years) after students complete their credentials, with a major focus and analysis on earnings changes for fields where a high share of programs have low initial earnings and are likely to fail earnings-based accountability policies like the gainful employment rule.</p>



<p>On Wednesday afternoon October 30th, conference attendees will be the first to learn about the initial findings of the Urban Institute’s report and also be provided with an overview of the second report, funded by CSPEN, during a presentation by Jason D. Delisle (<a href="https://cspen.us21.list-manage.com/track/click?u=9fa45d85dc7e4647608069698&amp;id=bc0ffea683&amp;e=3aeadd9061">cspen.us21.list-manage.com/track/click?u=9fa45d85dc7e4647608069698&amp;id=bc0ffea683&amp;e=3aeadd9061</a>) , Nonresident Senior Fellow, Center on Education Data and Policy at the Urban Institute. This second report will focus even more on the assertions that many short-term career training programs are unlikely to pass the Biden administration’s gainful employment regulation – mainly the rule’s high school earning benchmark. The driving assumption behind the policy is that these credentials are not providing value for students. But the debate around this policy has included little information about the students attending these programs other than the median earnings statistic, nor has it considered alternative benchmarks that might better incorporate non-earning benefits students receive from their programs or their pre-enrollment situations, particularly earnings and job quality. The second report will explore those factors with the aim of informing potential reforms to earnings-based accountability policies like the gainful employment rule.</p>



<p>CSPEN was able to donate to the development of this research as the result of a targeted donation provided by a benefactor who entrusted us to use the funding to promote research that could be used in support of our students, institutions, and employers of our graduates.</p>

<p><strong>More on The Urban Institute’s First Report<br></strong>There has been much debate about the features of earnings-based quality assurance policies (i.e. gainful employment), such as which fields and institutions the policies should cover, but there has been relatively little discussion about when earnings should be measured once students leave school to most accurately assess the payoff from the credential. The availability of data covering later years after students leave school, and the growing interest among policymakers to use these data for accountability policies, raises an important question about policy design: When should earnings be measured after students complete a credential to best capture whether the program pays off? If earnings are measured too early, fields where earnings are low initially but grow rapidly later could fail earnings-based accountability policies even if they provide value for students and taxpayers.</p>



<p>There is little consensus on an optimal year to measure earnings among different proposals. The Biden administration’s gainful employment rule, for example, measures earnings three years after completion and six years after completion for a few select fields (the Obama-era version of the rule measured at the second year). A prominent proposal advanced by Republicans in the U.S. House of Representatives in 2024 would measure short term credentials in students’ first year after completion, but later for other credentials. A Senate proposal from 2023 measures earnings as late as 5 or 6 years after students complete their credentials.</p>



<p>In this report, we examine how earnings change in the later years after students complete their credentials, and we explore the implications for earnings-based accountability policies and student loan repayment. We use new data from the College Scorecard showing students’ earnings up to 5 years after they complete a credential and assess which undergraduate and graduate fields show the most and least change during that time. We focus our analysis on earnings changes for fields where a high share of programs has low initial earnings and are likely to fail earnings-based accountability policies like the gainful employment rule.</p>

<h2 class="wp-block-heading">Heading Into The Tuesday, November 5th Election Day The Republican Agenda And Campaign Strategy Will Provide A Real Time Update From A Senior Advisor To The Trump Presidential Committee Days Before The 2024 Presidential Election</h2>



<p><strong>Overview</strong><br>CSPEN is pleased to announce that the morning Keynote speaker on Wednesday, October 30th will be the Honorable Stephen Stepanek – Senior Advisor to the Donald J. Trump for President 2024 Committee and Co-chairman of the 2024 Republican Platform Committee.</p>



<p>Throughout his distinguished career Stephen has always been a supporter of education and in particular higher education and workforce policy at all levels – local, state, and national,  Most recently Stephen worked with Tom Netting in support of the development and implementation of federal student financial aid revisions providing additional support for student borrowers.  A strong relationship was formed and Stephen and Tom have continued to remain in touch, speaking periodically on the latest developments in higher education and workforce development and ways to enhance, revise, and promote strong policies.</p>



<p>Heading into our 10th Annual Conference, Tom, on behalf of CSPEN, reached out to New Hampshire Republican Committee Chairman to see if he would be willing to share his insights with our community given his substantial knowledge and access at the highest levels of the Republican party.</p>



<p>CSPEN was thrilled to learn that Chairman Stepanek was willing to carve out literally twenty-four hours in his scheduled less than a week before the 2024 Presidential election to come off the campaign trail and share a real-time, up-to-the-minute, update on the elections, the Republican Party’s platform/positions related to higher education, workforce education, and more, and talk about what the post-election world would look like based upon a Republican or Democratic controlled White House, U.S. Senate, and U.S. House.</p>

<p><strong>Excerpts From Chairman Stepanek’s Bio</strong></p>

<p class="has-text-align-left">Chairman Stepanek’s political background embraces positions on the local and state level. He served as Amherst Town Selectman before being elected as New Hampshire State Representative. Over the duration of five terms, he held numerous positions including Vice Chairman of the Commerce Committee, House Minority Whip, Deputy Majority Leader, and Chairman of the Ways and Means Committee.</p>

<p class="has-text-align-left">Specifically in terms of building New Hampshire Republican efforts, Chairman Stepanek co-founded along with former Speaker of the House William O&#8217;Brien the Center Right meetings, organized and run by the Pine Tree Public Policy Institute. As a 501C4 organization these meetings are affiliated with Grover Norquist, and his Americans for Tax Reform organization and are currently in their 8th year, meeting the 2nd and 4th Wednesdays of each month.</p>

<p class="has-text-align-left">Chairman Stepanek also served as the New Hampshire Co chair of the Rudy Giuliani for President Committee, as well as co chair of the Donald Trump for President Committee in 2016. He was then appointed as the regional administrator of the GSA for New England. From there he went on to be elected and served 2 terms as the Chairman of the New Hampshire Republican Party. Stephen served on the RNC Platform committee in 2016, 2020 and 2024.</p>
